1. Data Controller
The controller of your personal data is:
FairEntertainment Karol Kwiatkowski
ul. Stanisława Kazury 11/21, Warsaw, Poland
NIP: 9512545687 | REGON: 522596230
E-mail: fairgamesfairgames@gmail.com
We operate under the brand “FairGames Studio”. For any matter relating to the processing of your personal data, please contact us using the details above.
2. What data we collect
a) Contact form
When you use the contact form on the Website, we process the data you provide:
- your name,
- your e-mail address,
- the project type you select (optional),
- the content of your message.
b) Technical and server log data
When you visit the Website, our server and our anti-abuse mechanisms automatically process certain technical data, including your IP address, the date and time of the request, the browser type and the pages accessed. Your IP address is also used on a short-term basis to enforce a rate limit on the contact form (one message per IP address per 24 hours) in order to prevent spam and abuse.
We do not use advertising, profiling or analytics tracking, and we do not build marketing profiles about you.
3. Purposes and legal bases of processing
- Responding to your inquiry and pre-contractual contact: Art. 6(1)(b) GDPR (steps prior to entering into a contract) and Art. 6(1)(f) GDPR (our legitimate interest in answering messages sent to us).
- Ensuring the security, stability and integrity of the Website (server logs, spam/abuse prevention, rate limiting): Art. 6(1)(f) GDPR (our legitimate interest in protecting our systems).
- Establishing, exercising or defending legal claims: Art. 6(1)(f) GDPR.
Providing data in the contact form is voluntary, but the name, e-mail address and message are necessary for us to be able to reply to you.
4. Recipients of the data
Your data may be shared with trusted entities that support the operation of the Website, acting as our processors or independent controllers:
- Our hosting provider, which stores the Website and its logs on a server located in the European Union.
- Google (Google Ireland Ltd. / Google LLC): messages submitted through the contact form are delivered to us by e-mail using the Gmail service; the Website also loads fonts from Google Fonts, which involves transmitting your IP address to Google.
- unpkg (Cloudflare): the Website loads an icon library from this content delivery network, which involves transmitting your IP address to the CDN provider.
We do not sell your personal data. Data may be disclosed to public authorities only where required by law.
5. Transfers outside the European Economic Area
Some of the providers listed above (in particular Google and Cloudflare) may process data outside the European Economic Area. In such cases the transfer is based on appropriate safeguards within the meaning of the GDPR, in particular the European Commission’s Standard Contractual Clauses and/or an adequacy decision (e.g. the EU-U.S. Data Privacy Framework). You may request more information about these safeguards using the contact details above.
6. How long we keep your data
- Contact form correspondence: for the time needed to handle your inquiry and afterwards for the period required to establish or defend potential claims, generally no longer than 3 years from our last contact.
- Server logs and rate-limiting data: for a short period necessary for security and diagnostics; rate-limiting IP entries are automatically removed within 24 hours.
7. Your rights
Under the GDPR you have the right to:
- access your personal data and obtain a copy of it,
- rectify (correct) your data,
- erase your data (“right to be forgotten”),
- restrict the processing of your data,
- data portability,
- object to processing based on our legitimate interest (Art. 21 GDPR).
To exercise any of these rights, contact us at fairgamesfairgames@gmail.com.
You also have the right to lodge a complaint with the supervisory authority. In Poland this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, uodo.gov.pl).
8. Cookies and local storage
The Website does not use advertising or analytics cookies. We only use storage that is strictly necessary for the Website to function (for example, to remember that you have seen the privacy notice). For details, please see our Cookie Policy.
9. Security
We apply appropriate technical and organisational measures to protect your data, including encrypted transmission (HTTPS/TLS), restricted access to data and protective HTTP security headers.
10. Children
The Website and our contact form are addressed to businesses and adults. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can remove it.
11. Changes to this Policy
We may update this Privacy Policy from time to time. The current version is always available on this page, with the “Last updated” date indicating the latest revision.
